1. Acceptance of Terms

By accessing or using any Pal's Sudden Service® digital property, including this website (EatPals.com, PalsJobs.com), any mobile application, or any other digital service operated by or on behalf of Pal's Sudden Service® (collectively, the "Platform"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use this Platform. Your continued use of the Platform constitutes acceptance of these terms as they may be updated from time to time.

2. Purpose of This Platform

These digital platforms are provided for general informational purposes only, including information about Pal’s Sudden Service® restaurant locations, menu offerings, employment opportunities, and the company. At this time, these platforms do not support online food ordering. All food orders must be placed in person at a Pal’s Sudden Service® restaurant location. Nothing on this Platform constitutes a binding offer, contract, guarantee of product availability, or commitment regarding menu items, hours, or services. All menu offerings, hours, and location information are subject to change without notice. Pal’s Sudden Service® is not responsible for inaccuracies in individual location information, as hours and availability may vary by location.

3. Independent Operator Disclosure

Pal’s Sudden Service® restaurant locations are owned and operated by independent licensee Owner/Operators. Each Operator is an independent business owner responsible for the day-to-day operations of their restaurant location, including but not limited to: hiring and employment decisions, food preparation and service, compliance with brand standards and with applicable local laws and regulations. Pal’s Sudden Service® is not responsible for, and expressly disclaims liability for, the acts, omissions, representations, or conduct of any individual Operator or their employees. Customers transacting at a Pal’s Sudden Service® location are doing so with the independently operating licensee at that location. No common, joint or co-employment exists between a location and Pal’s Sudden Service®, nor other Pal’s locations.

4. No Offer

Nothing on this Platform constitutes an offer to sell a franchise, license, business opportunity, or investment of any kind. Any offer of a Pal’s Sudden Service® license is made only as a written agreement and after a significant period of highly specialized training and exposure to the business. Prospective operators should not rely on any information on this Platform as the basis for making a business or investment decision nor view it as any guarantee of success.

5. Employment & Job Postings

Job postings and employment information displayed on PalsJobs.com and EatPals.com are provided for informational purposes only. Individual Pal’s Sudden Service® locations are owned and operated by independent Owner/Operators who make all hiring, compensation, and employment decisions for their respective locations. “Pal’s Sudden Service” is not the employer of record for positions at independently operated locations. Applying through this Platform does not create an employment relationship with Pal’s Sudden Service, nor does it guarantee an interview, offer of employment, or any other employment action. Employment applications submitted through the Platform are received directly by the relevant independent Owner/Operator, who is solely responsible for all employment decisions. Pal’s Sudden Service expressly disclaims any liability arising out of or related to the hiring process or employment practices of individual Operators.

6. Product Weight & Size Disclaimer

All product weights referenced on this Platform — including but not limited to patty weights such as “5.33 oz” — reflect the weight of ingredients before cooking. Actual cooked weights will be less due to moisture loss during the cooking process. All weights, sizes, and dimensions are approximate and may vary due to natural variation in ingredients and preparation methods. Product descriptions are provided for general informational purposes only and do not constitute a guarantee of exact specifications.

7. Photography & Food Imagery

Food and product photography displayed on this Platform is for illustrative purposes only. Actual products may differ in appearance, color, size, and presentation from images shown. Serving suggestions, garnishes, and styling shown in photographs may not be included with the standard product. Images should not be relied upon as an exact representation of the product you will receive at any Pal’s Sudden Service® location.

8. Nutritional Information

Calorie counts and nutritional information displayed on this Platform are approximate values based on standard recipes and preparation methods. Actual nutritional content may vary based on portion size, preparation variations, ingredient substitutions, and natural variation in raw ingredients. Nutritional data should not be relied upon as a precise measurement. Nutritional content may also vary by location.

2,000 calories a day is used for general nutrition advice, but calorie needs vary.

9. Allergen & Food Safety Warning

Pal’s Sudden Service® restaurants handle and prepare food containing major allergens, including but not limited to: wheat/gluten, milk/dairy, eggs, soy, peanuts, tree nuts, fish, and shellfish. Allergen profiles may vary by location. While reasonable precautions are taken, we cannot guarantee that any menu item is completely free from allergens or cross-contact with allergen-containing ingredients due to shared cooking equipment and preparation areas.

INDIVIDUALS WITH FOOD ALLERGIES OR DIETARY RESTRICTIONS ARE STRONGLY ENCOURAGED TO SPEAK DIRECTLY WITH AN OWNER/OPERATOR OR ASSISTANT MANAGER AT THEIR LOCAL PAL’S SUDDEN SERVICE LOCATION BEFORE ORDERING. Neither Pal’s Sudden Service® nor any individual Owner/Operator shall be liable for adverse reactions resulting from undisclosed allergen sensitivities or failure to notify staff of dietary needs prior to ordering.

10. Intellectual Property & DMCA Safe Harbor

All content on this Platform, website, software, mobile applications, and user interface elements — including but not limited to text, images, logos, graphics, trade dress, and design elements — is the property of Pal’s Sudden Service and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, transmit, or use any content from this Platform without the prior written permission of Pal’s. The Pal’s Sudden Service name, logo, trade dress, and related marks are trademarks of Pal’s Sudden Service®. Unauthorized use of any Pal’s Sudden Service trademarks is strictly prohibited and may subject you to legal liability.

If you believe in good faith that content appearing on this Platform infringes your copyright, you may submit a written notice to our designated agent containing: (i) identification of the copyrighted work claimed to be infringed; (ii) identification of the allegedly infringing material and its location on the Platform; (iii) your contact information including name, address, telephone number, and email address; (iv) a statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law; and (v) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf. DMCA notices may be submitted by mail to Pal's Sudden Service® at the address listed in Section 19, or via the contact form available on this Platform. Pal's Sudden Service® reserves the right to remove allegedly infringing content and to terminate accounts of repeat infringers.

TO THE FULLEST EXTENT PERMITTED BY LAW, PAL’S SUDDEN SERVICE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability & Indemnification

To the fullest extent permitted by applicable law, Pal’s Sudden Service® shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of — or inability to use — this Platform or its content, including but not limited to:

  • Loss of data, revenue, or profits
  • Errors or omissions in Platform content
  • Interruptions or unavailability of any Pal's Sudden Service® digital platform or service.
  • Any reliance placed on menu, nutritional, allergen, or location information provided on this Platform
  • Adverse reactions to food products resulting from failure to disclose allergen sensitivities to staff
  • Acts, omissions, or conduct of any independently operating Pal’s Sudden Service licensee or their employees
  • Employment decisions made by independent Operators

You agree to indemnify, defend, and hold harmless Pal's Sudden Service®, its Owner/Operators, officers, directors, employees, agents, licensees, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of or access to this Platform; (ii) your violation of these Terms of Use; (iii) your violation of any applicable law or regulation; (iv) any content you submit or transmit through this Platform; or (v) your infringement of any intellectual property or other right of any person or entity. Pal's Sudden Service® reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense, and you agree to cooperate fully with such defense.

13. Prohibited Use

You agree to use this Platform only for lawful purposes. You may not use this Platform to:

  • Violate any applicable local, state, or federal law or regulation
  • Transmit any unlawful, harmful, or objectionable content
  • Attempt to gain unauthorized access to any portion of the Platform or its related systems
  • Use automated tools (bots, scrapers, crawlers) to collect data from any Pal's Sudden Service® digital platform.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Harvest or collect personal information about other users without their consent
  • Reverse engineer, decompile, or attempt to extract source code from any Pal's Sudden Service® mobile application or software.

14. Third-Party Links & Services

This Platform may contain links to third-party websites or services (such as mapping tools, social media platforms, or third-party job platforms). Pal’s Sudden Service® does not control and is not responsible for the content, privacy practices, availability, or accuracy of any third-party sites. We encourage you to review the terms and privacy policies of any third-party services you access. We are not responsible for and do not endorse any products, services, or content offered by third parties.

15. Digital Accessibility

Pal’s Sudden Service is committed to making this Platform accessible to all users, including individuals with disabilities, in accordance with applicable law. 16. Privacy

Any personal information you provide through the Platform (such as through contact forms or email) will be used solely to respond to your inquiry or provide requested services, and will not be sold, rented, or shared with third parties except as required by law or as described in our Privacy Policy. Employment inquiries and applications submitted through PalsJobs.com are received directly by the relevant independent Owner/Operator, who is solely responsible for their receipt, handling, and processing. Please review Section 20 of these Terms for our Privacy Policy.

In the event Pal's Sudden Service® makes a mobile application or other downloadable digital service available in the future, users of any such application acknowledge that it may request access to certain device features and data, which may include but are not limited to: device location, push notification permissions, camera access, and device identifiers for analytics and performance purposes. Users would be able to manage such permissions through their device settings at any time, and disabling certain permissions may limit functionality.

Should a Pal's Sudden Service® mobile application become available, any push notification features would be optional, and users may opt in or withdraw consent through their device settings. Pal's Sudden Service® would not be responsible for notifications delivered after consent has been withdrawn pending system synchronization.

Should account creation become available within any Pal's Sudden Service® digital application, users would be responsible for maintaining the confidentiality of their login credentials and for all activity occurring under their account, and would agree to notify Pal's Sudden Service® promptly of any unauthorized access.

Should any Pal's Sudden Service® digital application be made available through third-party distribution platforms, use of any such application would also be subject to the applicable terms and conditions of those distribution platforms, which operate independently of these Terms of Use.

If Pal's Sudden Service® expands the Platform to include a mobile application, features that collect additional categories of personal information — such as payment data, order history, or for Pal’s gift certificate use — a supplemental or updated privacy policy will be made available within the Platform at that time, and your continued use will constitute acceptance of those updated terms.

This Platform is not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 13, please do not use this Platform or submit any information through it. If we become aware that we have inadvertently collected personal information from a child under 13, we will take prompt steps to delete such information. Parents or guardians who believe their child has submitted personal information through this Platform may contact us at the address listed in Section 19 to request its removal.

By submitting any idea, suggestion, feedback, concept, or other creative material to Pal's Sudden Service® through this Platform, its contact form, by mail or email, in person, or any other means ("Submission"), you acknowledge and agree that: (i) your Submission is not confidential and no confidential or fiduciary relationship is created between you and Pal's Sudden Service® by virtue of the Submission; (ii) Pal's Sudden Service® has no obligation to review, consider, compensate you for, or return any Submission; (iii) Pal's Sudden Service® may already be developing, or may in the future develop, ideas or products similar or identical to your Submission independently, and you agree that such independent development does not constitute misappropriation or any other wrongful act; and (iv) you grant Pal's Sudden Service® a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate your Submission into its business, products, or services without attribution or compensation of any kind. If you do not agree to these terms, please do not submit ideas or suggestions to Pal's Sudden Service® by any means.

17. Governing Law, Dispute Resolution, Severability

These Terms of Use are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. Any dispute arising out of or related to your use of this Platform shall be resolved exclusively in the state or federal courts located in Sullivan County, Tennessee or in the federal district and division that includes Sullivan County. You consent to the personal jurisdiction of such courts. Pal's Sudden Service® is a registered trade name under which this Platform is operated. The legal entity operating this Platform is a limited liability company organized and existing under the laws of the State of Tennessee.

If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect. The failure of Pal's Sudden Service® to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision on any future occasion.

18. Changes to These Terms

Pal’s Sudden Service® reserves the right to update or modify these Terms of Use at any time without prior notice. Changes will be effective immediately upon posting to any Pal's Sudden Service® digital platform covered by these Terms. Your continued use of the Platform following any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.

We do not collect payment information, and the Platform does not currently support online ordering or user account creation. The Platform may use cookies to enhance your experience; you may disable cookies through your browser settings, though some Platform features may not function properly as a result.

How We Use and Share Your Information
Information you provide is used solely to respond to your inquiry, process your application, or improve the Platform. We do not sell or rent your personal information. We may share your information only: (i) with independent Owner/Operators who are solely responsible for receiving and processing employment inquiries and applications submitted through PalsJobs.com; (ii) with third-party service providers who assist in operating the Platform, under confidentiality obligations; or (iii) as required by law.

Data Retention and Your Choices
We retain personal information only as long as necessary to fulfill the purposes described above or as required by law. To request correction or deletion of information you have submitted, please contact us using the information in Section 19.

Children's Privacy
This Platform is not directed at children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has submitted information through the Platform, please contact us at the address in Section 19 and we will promptly delete it.
